The opposition-sided Democratic Green Party of Rwanda has brought to justice the case against the Rwandan Government according which the amendment of the Constitution is illegal and should not be approved by the Supreme Court as its defender. Today the Supreme Court approved that both sides( Green Party and Gvt’ representatives) will be heard by the Court to find our which side is legally right or wrong.
The today’s court decision from the supreme court approved that this case will be treated in the Supreme court as it is in obligation to deal with every matter pertaining to the stability of the Constitution.
Judge Immaculee Nyirinkwaya said told the audience that Rwandan government will be defending itself on why the Constitution needs to be amended while some of its articles forbid it.
The judge informed that the court hearings between both sides on that matter will take place on , September, 23, this year.
The Chief politician of the Green Party Rwanda Dr Frank Habineza commended that court’ decision adding that this will be an occasion to prove that the amendment of the Constitution is unconstitutional.
Lawyer Epimaque Rubango who defends the Government’s position on this matter did not react abotu the court’s decision, agreeing his failure at this first stage of the affair.
Green Party had decried the fact that the article 101 of the Constitution needs to be amended so to allow President Kagame run for the next term in the Office.
Recently the Head of State approved the creation of the National Commission entitled to help the MPs revise and re-write some of the Articles in the Constitution including the controversial article 101.
Observers claim that the President’s approval is ‘an obvious indicator’ that the Constitution will surely be amended.
