The Douai Court, in Northern France,refuses to send Col Serubuga in Rwanda claiming that the Prosecution does not prove Serubuga guilty .
Col Serubuga was arrested in Cambrai, Northern France on July,2013 due to the International warrants against him issued by Rwanda. Since then Rwandan has urged France to send him to Rwandan justice but France did not.
He fled to France in 1998 and he is known to have been one of the most financial military officers of the Ex-FAR, former Rwandan armed forces. He is accused to have masterminded and backed the genocide committed against the Tutsi in 1994.
His defense says that until now no tangible proof on Serubuga’s involvement on Genocide is shown yet and proven true, thus his today’s release by French Tribunal in Douai .
Lawyer Thierry Massis who defends Serubuga in court , last month told journalists that Serubuga is being accused due to his presumed Hutu identity. Lawyer Massis says that France is not bound to send Col Serubuga to Rwanda because according to him it is against the European Charter of Justice ,which Rwanda did not sign.
