A judge who started hearing the case involving Dr Niyitegeka Theoneste and the manager of the prison where is jailed told the audience that he can’t continue treating the case, urging that it should be tried in the area where it’s supposed to have been committed.
Dr Niyitegeka Theoneste who once presented his candidature for the presidency (2003), presented his case, accusing the manager of Nyanza prison of jailing him in unlawful manner.
As the judge was pronouncing his decision, the prison’s manager and the prosecutors were absent in the court.
The accused told the court that he brought his case to Nyamabuye court due to the fact that this court is located in the area where the former Gacaca court that convicted him to 15 years of imprisonment was located.
However, the judge informed that Nyamabuye court is not entitled to treat such a case but rather, the concerned people should bring this case to authorized court, namely the Busasamana court.
