The Law does not allow the Ombudsman to prosecute some cases – Kajangana

Kajangana Jean Aimé, Director of the Monitoring of Interdictions and Incompatibilities of Senior Officials told the Isango  star that Law that penalizes officials for the alleged involvement in cases such as corruption or immorality, among others, does not allow them to bring some of the accused in court.

Aimee Kajangana explained that some cases are not in the duties of the Office of the Ombudsman to persecute

He was explaining to journalists why the officials who have recently resigned for their ‘so-called personal motives’ but who, afterwards, were suspected to be  involved into illegal activities are not brought to justice by the Office of the Ombudsman.

Kajangana revealed that the Law does provide them with the ability to publish the names of the people who are listed by the persecution in order to let the public know their names.

He said that the Office encourages that the CEO’s to deal with such cases and this has been done in different manners, he added.

If the cases are of national interest or involves wide range of people, other organs as such as Police or persecution authority  intervene.

Presenters of the show were wondering why the fact that if an official resigns from one post, he/she joins another post and this does not provide justice to people who might have been the victims of the previous actions of the resigned officials, they added.

For them , further investigation and actions should be taken as to persecute the suspects and therefore provide transparency instead of changing one’s administrative position to another.

Kajangana said that the Office of the Ombudsman provides training to all agents concerned with the Law, namely officials, journalists, police agents so to equip them with the required understanding of this law so that none might present excuses in regard to its application.

Asked whether the Office has some cases of officials whose names were brought to justice by the Office of the Ombudsman, Kajangana responded that some cases did, but others did not depending on the competency that the law does not provide with the Office of the Ombudsman with higher legal ability to persecute them.

If a citizen brings up a case to the Office of the Ombudsman we first ask whether the case has been presented to the lower levels as to respect institutional hierarchy in solving such issues.

Lambert Usenga did criticize the fact the ones who resign do not explain themselves to the public about the reason of their resignation and this leaves people with much speculation.

To this, Kajangana explained that this might depend on different reasons including one’s will.

Asked about the role of media in reporting about these sensitive issues, Usenga said  that everything necessary is done to report on it  depending on  the available means and source of information.

He said that some source of information, namely the persons involved, often are hesitant to provide needed information and this hinders reporters from fulfilling their duties.

Listeners asked why the officials do not explain to the public the roots of their resignation, adding that it is in their responsibilities to do so if they are not to blame.

The participants in the show discussed also about the Ebola outbreak in the highly industrialized nations including USA and Europe, a situation that proves that every nation is threatened by the disease regardless the economic stability.
